“100% Compensation Guaranteed”
What does this mean? This is a good question. It certainly does not mean 100% of the compensation to which you are entitled. That is because you would then receive more than the claim is worth if you are partly to blame for the accident or your injuries. For example, it is accepted by the Courts that if you are not wearing a seat belt your compensation should be deducted by 25%. It is unlikely the firms that advertise “100% compensation guaranteed” are offering to top up the award by the missing 25%.
In reality we suspect they are offering to give the client 100% of the negotiated compensation award.
What you need to consider here is what is being measured. 100% awarded using a panel firm can be considerably less than the real value. Park Woodfine Heald Mellows LLP does not promise 100% and while we mostly do give the client 100%, sometimes we take up to 5%. However, we are confident the client will still receive more than the “100% compensation guaranteed”.
