Divorce
To obtain a divorce you must have been married for at least one year and you must be able to show that your marriage has irretrievably broken down on the basis of one of the five facts; Adultery, Unreasonable behaviour, Desertion, 2 years separation with the other party’s consent or 5 years separation without consent.
The legal effect of a divorce once it has become final is to bring your marriage to an end. Both parties will then be free to remarry if they wish. A divorce can usually be finalised within 4 to 6 months, but this may vary depending on the facts of your case. Inevitably there will be other issues to consider as well as the actual divorce process. We can offer you advice about Children, your family Finances including the division of property and Domestic Violence.
If you and your spouse are on amicable terms and wish to bring your marriage to an end in a co-operative way, our Head of Department, Claire Trundley is an experienced Collaborative Lawyer. The Collaborative Law scheme aims to resolve family disputes face to face in partnership with your spouse rather than through the Courts.
