Whistlebowing allegations
Employees may bring a claim in the Employment Tribunal for automatic unfair dismissal, victimisation or detriment where there is an allegation that the reason for this is as a result of a protected disclosure having been made. Workers will have the save rights save for unfair dismissal.
Whilst a claim for unfair dismissal must be brought within 3 months of termination, a claim for detrimental treatment must be presented “before the end of the period of three months beginning with the date of the act or failure to act to which the complaint relates or, where that act or failure is part of a series of similar acts or failures, the last of them.” The time limits however are subject to the Tribunal’s discretion to extend in certain cases.
