Employment Team Hit the Headlines

Asad Rana and Claire Yates, both solicitors within the Employment Department, successfully defended Flitwick Town Council after a claim was brought against them by a former employee who claimed that she had been dismissed after making whistle blowing allegations. The case was reported in the Times and Citizen below.

The Claimant alleged that she had been dismissed for complaining about the Town Clerk along with raising allegations that the Town Clerk failed to advertise elections properly, took negative comments down from the Town Council's website and took short cuts to buy land and gain planning permission.

Flitwick Town Council maintained that the town clerk's assistant had been suspended in November 2007 and was subsequently dismissed after accessing confidential computer files and photocopying the Town Clerk's diary.

Employment Judge Lancaster rejected the Claimant's case, explained that "the principal reason the Claimant was dismissed was not because the Claimant made any protected disclosures. It was that she was seen as committing misconduct. In these circumstances it is clear that dismissal on these grounds as a sanction fell within the bounds of reasonable responses. It is therefore fair".
