Owner wins case against livery yard
An owner has won a damages case against the proprietor of a livery yard after his horse sustained serious injuries when turned out in a field containing farm machinery.
Kalato, a five year old Dutch Warmblood, needed surgery after lacerating his legs when his head collar became entangled in a tractor bucket at whitewood House Farm, Surrey.
Carol Wright of Park Woodfine Heald Mellows, who acted for the owner of Kalato, said the case went in her clients favour owing to a breach of the Farms duty of care.
"The contract stated that the livery yard would exercise reasonable care for the horses safety," she explained "But by putting Kalato in a field with machinery, the livery yard breached their duty of care."
The livery yard owners were ordered to pay £4,800 towards vets bills and loss of use
