Charities Act
On the 8th November 2006 the Charities Act became law, having received Royal Assent, following a lengthy passage through Parliament.
As a leading regional law Firm with specialist expertise in Charity Law, Park Woodfine Heald Mellows LLP have been monitoring the Act as it passed through the many stages of the legal process.
Rae Levene – Managing Partner, Park Woodfine Heald Mellows LLP says "The Act has been a long time coming and we do not know yet when the various sections of the Act will be brought into force but what is certain is that it will have a major impact on the sector."
Started in May 2004, the Act has been the subject of debate and consultation since July 2001.
Rae say "This is the first review of charity legislation since 1993 and has far reaching consequences. Gone are the four areas of the charity Act established over many centuries to be replaced with 12 areas. It also introduces a new legal entity for charities, the Charitable Incorporated Organisation as well as further regulation of fundraising, delivery of accounts, remuneration of trustees and many other elements which have been the subject of discussion within the sector for many years."
It is unlikely that the Act will be implemented in one hit
