Compulsory Mediation for all Divorcing Couple - 6th April 2011
From 6th April 2011, all divorcing couples will have to attend a compulsory mediation awareness session. This ruling will apply in all cases except those involving domestic violence and child protection.
The cost of attending the mediation sessions will be met by the couple. If either party refuses to attend, separate meetings can be held.
Before proceedings for divorce can be filed the couple will have to submit a form confirming their attendance at mediation. The Ministry of Justice want to give couples a chance to discuss their separation before the case reaches the courts. This does not prevent cases going to court if that is the most suitable option in an individual case. Compulsory mediation sessions are already in place for legally aided divorces and disputes.
