Charity & Contracts
All organisations are involved with contracts at one time or another. Property dealings, employment contracts, supplies of goods and services both to and by the charity, granting other providers contracts or protecting your trademarks all involve contracts. Of course, it is possible to draft these contracts without sound legal advice but should things go wrong, this is often where organisations (not just charities) come unstuck.
Our Charity Team are aware of both the commercial and charitable nature of charites and social enterprises and are able to keep in mind both aspects when advising your charity on its contracts. There are some unique points to be aware of when entering contracts as a charity rather than any other type of commercial organisation and it is for this reason we would advise you seek assistance in drafting your contracts.
There may also be tax implications, especially where sponsorship contracts are involved. Charity Law imposes regulations upon entering into certain types of contract, suchas contracting with commercial partners for fundraising purposes.
